Release and Waiver of Liability

PLEASE READ CAREFULLY. THIS AFFECTS YOUR LEGAL RIGHTS.

1. Agreement

This Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement (this "Release") is between you and Epic Electric Scooters Inc., operating as Your Touring (together with its directors, officers, employees, contractors, agents, licensors, and partner businesses that distribute access codes, the "Released Parties"). By purchasing or activating a pass, redeeming a store access code, or otherwise using the Service to plan, navigate, or follow any route or visit any location (the "Activities"), you agree to this Release. If you do not agree, do not use the Service for in-person activities.

2. Nature of the Service

Your Touring is a software service that suggests self-guided routes and points of interest. The Released Parties do not guide, escort, supervise, or accompany you; do not inspect, control, or maintain any route, road, path, sidewalk, trail, venue, or attraction; and make no representation that any route or location is safe, lawful to access, open, or suitable for you or your group.

3. Acknowledgement and assumption of risk

You understand that the Activities involve inherent risks that cannot be eliminated, including, without limitation:

  • collision with or being struck by motor vehicles, bicycles, scooters, or pedestrians; falls; slips and trips on uneven, wet, icy, or obstructed surfaces;
  • risks of operating or riding a bicycle, e-bike, scooter, or other vehicle, including mechanical failure and loss of control;
  • weather, terrain, water hazards, wildlife, and low visibility;
  • crime, and the conduct of third parties, at or near suggested locations;
  • routes or directions that are inaccurate, out of date, or affected by construction, closures, or events;
  • device failure, loss of GPS or network coverage, and battery depletion;
  • overexertion, pre-existing medical conditions, and delayed access to medical care.

YOU VOLUNTARILY ACCEPT AND ASSUME ALL SUCH RISKS, WHETHER OR NOT LISTED ABOVE, INCLUDING RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, AND FULL RESPONSIBILITY FOR ANY RESULTING PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR LOSS.

4. Your responsibilities

  • Use your own judgment at all times. Do not follow a suggested route into any situation that appears unsafe or unlawful.
  • Obey all traffic laws, signals, signage, and local regulations, including helmet and equipment laws.
  • Do not read or interact with the Service while riding or driving; stop safely first.
  • Ensure you are physically fit for the planned activity, carry water and appropriate clothing, and monitor weather conditions.
  • Supervise all minors and members of your group; you accept this Release on behalf of any minor in your care to the fullest extent permitted by law.
  • Respect private property, venue rules, and admission requirements; the Service's inclusion of a stop is not permission to enter.

5. Release and waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU, FOR YOURSELF AND YOUR HEIRS, EXECUTORS, ADMINISTRATORS, AND ASSIGNS, HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, ACTIONS, AND LIABILITIES OF EVERY KIND, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, ARISING OUT OF OR CONNECTED WITH THE ACTIVITIES OR YOUR USE OF THE SERVICE, INCLUDING CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, AND YOU AGREE NOT TO SUE THE RELEASED PARTIES FOR ANY SUCH CLAIM. THIS RELEASE DOES NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED BY LAW, SUCH AS LIABILITY FOR GROSS NEGLIGENCE, RECKLESSNESS, OR INTENTIONAL MISCONDUCT WHERE SUCH EXCLUSION IS PROHIBITED.

6. Indemnity

You agree to indemnify and hold the Released Parties harmless from any claims, damages, and expenses (including reasonable legal fees) brought by any third party, including members of your group, arising out of your Activities, your breach of this Release, or your violation of law.

7. Medical authorization

If you are injured during the Activities and unable to act for yourself, you authorize emergency medical treatment at your own expense. The Released Parties have no duty to provide, arrange, or pay for medical care.

8. Severability, governing law, and acknowledgement

If any part of this Release is held invalid, the remainder continues in force, and the invalid part is deemed modified to the minimum extent necessary to be valid. This Release is governed by the laws of Prince Edward Island and the federal laws of Canada applicable in it. Subject to mandatory consumer protection rules of your residence, the courts of Prince Edward Island have exclusive jurisdiction.

YOU CONFIRM THAT YOU HAVE READ THIS RELEASE, UNDERSTAND THAT IT IS A WAIVER OF SIGNIFICANT LEGAL RIGHTS INCLUDING THE RIGHT TO SUE, AND AGREE TO IT FREELY AND VOLUNTARILY. IN THE SERVICE, YOUR AGREEMENT IS RECORDED WHEN YOU CHECK THE ACCEPTANCE BOX OR ACTIVATE A PASS.
