Terms of Service

1. Who we are and what these Terms cover
These Terms of Service (the "Terms") are a binding agreement between you and Epic Electric Scooters Inc., operating as Your Touring ("we", "us", "our"), of 305-119 Queens Street, Charlottetown, Prince Edward Island, C1A 4B3 Canada. They govern your access to and use of the Your Touring website and related online services (together, the "Service"), including self-guided tour routes, navigation, tour passes, store access codes, and business subscriptions. By accessing or using the Service, purchasing a pass, redeeming a store code, or creating a business account, you agree to these Terms and to our Privacy Policy, Refund Policy, and Release and Waiver of Liability, which are incorporated by reference. If you do not agree, do not use the Service.
2. Eligibility
You must be at least the age of majority in your jurisdiction to purchase a pass or create an account. Minors may use the Service only under the supervision of a parent or guardian who accepts these Terms on their behalf and remains responsible for their use and safety at all times.
3. Accounts
Individual accounts are created automatically when you purchase a pass or redeem a store access code with your email address. Individual accounts are passwordless; access to saved tours and profile information is verified by a sign-in link sent to your email.
Business accounts are created through the business registration flow and are protected by a password. You are responsible for keeping your password confidential and for all activity under your account.
You must provide accurate information, including a valid email address and, for businesses, a genuine business address. We may suspend or close accounts created with false information.
Personal accounts and business accounts are separate. Only one may be signed in on a device at a time.
4. Passes and access
An individual tour pass grants access to full tour content and navigation for 48 hours from activation, for one person, for personal, non-commercial use.
Store access codes are provided by participating businesses under an active business subscription. A code grants the same 48-hour pass at no charge to you. Codes may be limited (including one redemption per email per business per 24 hours), may stop working if the business's subscription becomes inactive, and may be changed or revoked at any time. Passes already activated remain valid until they expire.
Passes and codes are non-transferable and may not be resold, published, or shared publicly. We may invalidate passes or codes obtained or distributed in breach of these Terms.
Portions of the Service, including a limited number of tour stops, may be available without payment. We may change what is free and what is paid at any time.
5. Business subscriptions
A business subscription is billed monthly in advance at the price shown at signup (currently $49.99 per month, plus applicable taxes) and renews automatically until cancelled.
An active subscription entitles the business to a store access code, a QR code, redemption tracking, and the other features described at signup. Features may be updated over time.
If a payment fails, we may mark the subscription inactive, deactivate the store code, and retry payment. Reinstating payment reactivates the subscription and code.
You may cancel at any time, effective at the end of the current billing period. Your code stops working when the subscription ends. See the Refund Policy.
One business account per physical location. We may refuse or unwind registrations that duplicate an address already on file, and may verify ownership of a location before granting or transferring an account.
Businesses must present codes honestly to their customers and must not represent themselves as our agent, partner, or affiliate beyond being a subscriber.
6. Payments
Payments are processed by our third-party payment processor (currently Stripe). We do not store full card numbers. You authorize us and our processor to charge your chosen payment method for the amounts shown at checkout, including recurring subscription charges. Prices may change; for subscriptions we will give at least 30 days' notice before a price change takes effect at your next renewal. You are responsible for any taxes, foreign exchange fees, or carrier data charges.
7. The Service is informational — your safety is your responsibility
The Service suggests routes and points of interest. It is not a guided tour, a safety service, or a substitute for your own judgment. Routes are generated automatically and may be affected by construction, closures, traffic, weather, terrain, local events, or errors in third-party map data. Opening hours, admission fees, and descriptions of stops may be inaccurate or out of date. You are solely responsible for your own safety, for supervising anyone in your group, for obeying traffic laws and local regulations, for the safe operation of any bicycle, scooter, or vehicle, and for assessing whether any route, road, path, or location is safe and suitable for you. Do not interact with the Service while riding or driving. Your use of the Service for any in-person activity is subject to the Release and Waiver of Liability.
8. Acceptable use
- Do not scrape, copy, republish, or resell tour content, stop libraries, routes, descriptions, or photographs.
- Do not circumvent, or attempt to circumvent, payment, pass limits, locked content, or code redemption limits.
- Do not use the Service to violate any law, infringe any rights, or harass anyone.
- Do not interfere with the Service's operation, probe or test its security, or access it by automated means except public search indexing.
- Do not upload malicious code or content that is unlawful, misleading, or infringing.
We may suspend or terminate access for breach of this Section without refund.
9. Your content
If you submit content to the Service (for example, adding a custom stop, business details, a logo, or feedback), you grant us a worldwide, non-exclusive, royalty-free licence to host, use, reproduce, and display that content for the purpose of operating, improving, and promoting the Service. You confirm you have the rights to what you submit. We may remove content that breaches these Terms.
10. Our intellectual property
The Service, including software, design, tour routes, stop descriptions, photographs we own or licence, trade marks, and logos, is owned by us or our licensors and protected by law. Except for the limited personal or business use expressly allowed, no rights are granted to you. Map data and imagery are provided by third parties (including Google) and are subject to their terms.
11. Third-party services
The Service depends on third-party services, including map, navigation, hosting, email, and payment providers, and may link to third-party websites or venues. We are not responsible for third-party services, their availability, or their content, and your use of them may be subject to their own terms.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT ROUTES OR STOP INFORMATION WILL BE ACCURATE, SAFE, OR CURRENT, OR THAT LOCATION SERVICES WILL FUNCTION ON YOUR DEVICE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL; (B) WE WILL NOT BE LIABLE FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM YOUR IN-PERSON ACTIVITIES, TRAVEL, OR USE OF ANY VEHICLE, BICYCLE, OR SCOOTER WHILE USING OR FOLLOWING THE SERVICE; AND (C) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (I) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (II) $50 CAD. THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW, INCLUDING UNDER APPLICABLE CONSUMER PROTECTION LEGISLATION.
14. Indemnity
You will indemnify and hold us, our directors, officers, employees, and agents harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, your violation of law or third-party rights, or, for business subscribers, claims by your customers relating to your presentation of the Service or codes.
15. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate the Service or your access to it for breach of these Terms, suspected fraud or abuse, legal requirements, or discontinuation of the Service. Sections that by their nature should survive (including 7, 9, 10, 12, 13, 14, 17, and 18) survive termination.
16. Changes to the Service and these Terms
We may modify the Service and these Terms. For material changes we will give notice by email or in the Service at least 30 days before they take effect where required. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service; for paid subscriptions, you may cancel effective at the end of the current period.
17. Governing law and disputes
These Terms are governed by the laws of the Province of Prince Edward Island and the federal laws of Canada applicable in it, without regard to conflict of laws rules. Subject to any mandatory consumer protection rights in your place of residence, the courts of Prince Edward Island have exclusive jurisdiction over disputes arising from these Terms or the Service. Before starting a claim, you agree to contact us at support@epicelectricscooters.com and attempt in good faith to resolve the dispute for 30 days.
18. General
These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Service. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
